Zenvyte Acceptable Use Policy

This Acceptable Use Policy (“AUP”) describes conduct that Zenvyte LLC (“Zenvyte”) prohibits in connection with use of its Services. By ordering or using the Services, you (the “Customer” or service recipient) agree to comply with this AUP and all applicable laws. This AUP is informational and is not a substitute for legal advice. Customer agrees not to use, and not to permit any end user or third party to use, the Services for any of the following:

• Illegal, abusive, false, fraudulent, deceptive, or misleading activity, or any activity that exploits, harms, or threatens to harm children.
• Unsolicited advertising, marketing, or telemarketing that violates applicable law, including Section 5 of the FTC Act (15 U.S.C. § 45), the CAN-SPAM Act (15 U.S.C. §§ 7701–7713), the Telemarketing Consumer Fraud and Abuse Prevention Act (15 U.S.C. §§ 6101–6108), the FTC Telemarketing Sales Rule (16 C.F.R. § 310), the Telephone Consumer Protection Act (47 U.S.C. § 227), FCC implementing regulations (47 C.F.R. § 64.1200 et seq.), and any applicable federal or state Do-Not-Call or calling-time restrictions.
• Use that fails to conform to applicable industry standards, including CTIA messaging guidelines and short code best practices.
• Attempting to bypass, disable, or interfere with any security mechanism of the Services, or otherwise creating a security or service risk.
• Reverse-engineering the Services for any improper purpose.
• Conduct that could expose Zenvyte or third parties to liability, damages, or danger.
• Launching or facilitating denial-of-service attacks or other conduct that disrupts the availability, reliability, or stability of the Services.
• Transmitting viruses, malware, or other harmful code.
• Processing Protected Health Information (as defined by HIPAA) through the Services without a signed Business Associate Agreement with Zenvyte, unless an applicable exception applies.
• Transmitting material that infringes the intellectual property or other rights of third parties.
• Transmitting libelous, defamatory, discriminatory, or otherwise harmful material.
• Falsifying caller ID, email headers, or sender identity, or otherwise misrepresenting the origin of a call or message, including any violation of the Truth in Caller ID Act (47 U.S.C. § 227) and its implementing regulations (47 C.F.R. § 64.1604).

This list is illustrative, not exhaustive. Zenvyte determines violations of this AUP in its sole, reasonable discretion and may revise this AUP at any time, with changes effective upon posting to the Zenvyte website. Continued use of the Services after a change constitutes acceptance of the revised AUP.

If Customer violates this AUP, Zenvyte may, consistent with the terms of the applicable Agreement, suspend or terminate Services, close the account, or block delivery of communications to enforce these terms. Zenvyte reserves the right to review relevant account or communications data when investigating a suspected violation, but does not undertake to monitor all Service traffic and makes no representation that it does so.
